Release: Direct response advertising for the Excelerene Weight Loss Formula came to the attention of the National Advertising Review Council’s Electronic Retailing Self-Regulation Program (“ERSP”) pursuant to ERSP’s ongoing monitoring program.

MARKETER’S POSITION
According to Metabo Up, following a brief and very small media test, Excelerene is no longer being sold to the public in direct response advertising or any other marketing channel. The marketer also verified to ERSP that there is no longer a website for Excelerene where the product is being advertised or sold.  Moreover, the marketer confirmed that, at this time, there are no plans to resume the advertising for Excelerene that was the subject of this inquiry, although Metabo Up reserved its right to reintroduce the product in the future through different advertising. Nevertheless the marketer asserted that there is no current intention of using the claims at issue in the same context in any future advertising.

BASIS OF INQUIRY
Direct response advertising for the Excelerene Weight Loss Formula came to the attention of the National Advertising Review Council’s Electronic Retailing Self-Regulation Program (“ERSP”) pursuant to ERSP’s ongoing monitoring program.  Based on ERSP’s initial review of broadcast and online advertising for Excelerene, the following representative core claims were identified regarding the general efficacy of the product:

1. Performance Claims
“This exclusive block and burn technology will help eliminate calories and
is proven to cause amazing weight loss results”
“In a recent double blind study published in the International Journal of
Medical Sciences the people who took the blocking active ingredient lost 5
times more weight than the placebo group”
“Scientists conducted a separate clinical study on the burning ingredient
and people lost 48% more weight by burning excess calories”
“You will lose weight and have hours of increased energy guaranteed”

2. Establishment Claims
“Action One is clinically proven to help block the bad calories from
starchy carbs”
“Action Two is clinically proven to help burn calories and increase your
metabolism”

3. Superiority Claims
“For the very first time, 2 exclusive weight loss ingredients have been
combined to form what could be the most powerful weight loss product
ever developed.”
“Most powerful weight loss formula available today”

ADMINISTRATIVE DETERMINATION
The marketer has represented in writing that the broadcast advertising that was the subject of this inquiry has been permanently discontinued and that the website which contained some of the claims at issue has been disabled. ERSP expressed its appreciation to the marketer for its voluntary actions in this regard.  In addition, Metabo Up indicated that it has no present intentions of disseminating the claims that were the basis of inquiry in this review in the same  context in future advertising.
