Connecticut Probes Acai Berry Scams
Connecticut Attorney General Richard Blumenthal is investigating the business practices and questionable science associated with Acai berry products — primarily pitched by Internet-based companies as a wonder treatment for weight-loss.
Blumenthal’s office has received numerous consumer complaints related to Acai berry purchases, and is investigating with other states.
There is no competent scientific research that demonstrates any of the claimed effects of Acai berry, including weight loss, detoxification and increased energy and vitality, Blumenthal said.
Blumenthal said various companies selling Acai berry products — in addition to bogus weight loss claims — have improperly charged consumer credit cards.
After promising 14-day “free trials” of Acai berry products, the companies often make it virtually impossible for consumers to cancel the trial, resulting in charges to consumer credit cards ranging anywhere from $59 to $89.
Even worse, some consumers never even receive the product within the trial period — making it impossible to try the product before deciding whether to cancel.
That’s what happened to Robin of Covington, Ga., who complained to ConsumerAffairs.com about her dealings with Advanced Wellness Research.
“I ordered the free trial of Acai Berry capsules for $4.99. It took 2 weeks to get the bottle. That’s their SCAM..you have to call withing 14 days to cancel. It’s hard to cancel when you haven’t received the product! … On my next credit card statement, I had been charged $78.81 on 2/7/09 and another $83.80 on 2/22/09.”
“There are no magical berries from the Brazilian rainforest that cure obesity — only painfully real credit card charges and empty weight loss promises,” Blumenthal said. “Aggressive Acai berry pitches on the Internet entice countless consumers into free trials promising weight loss, energy and detoxification. These claims are based on folklore, traditional remedies and outright fabrications — unproven by real scientific evidence.
“In reality, consumers lose more money than weight after free trials transition into inescapable charges. We will investigate these allegedly misleading or deceptive nutrition and health claims and take action under our consumer protection statutes — as we have done with other food products. As problematic as the berries are the bills.
“Supposedly free online product offers commonly entail costs. These false celebrity endorsements and fake blogs show the dark side of online marketing.”
David Schardt, senior nutritionist for Center for Science in the Public Interest, said, “If Bernard Madoff were in the food business, he’d be offering ‘free’ trials of açai-based weight-loss products. Law enforcement has yet to catch up to these rogue operators. Until they do, consumers have to protect themselves.”

If they don’t get your money with the celebrity “testimonials” they will probably get you to buy into “the regular stay at home mom that lost weight eating cheesy poofs, corn dogs, and pizza without diet and exercise”

In discontinuing these claims, the marketer noted that it has no present intent of making these claims in future advertising although it reserved its right to consider what new claims it may wish to make that are supported by its evidence.
BASIS OF INQUIRY
Direct response advertising for Acaiberry Power 500 dietary supplement,
marketed by Crush, LLC (Crush), came to the attention of the National
Advertising Review Council’s Electronic Retailing Self-Regulation Program
(“ERSP”) pursuant to ERSP’s ongoing monitoring program. Based on our initial review of online (MySpace, Facebook, and website) advertising for Acai Berry Power 500 the following representative core claims were identified as being communicated for the AcaiBerry 500 dietary
supplement:
1. Performance Claims
“Acai Berry Body Cleanse flush pounds and remove toxins safely.”
“Flush Pounds and Pounds of Waste and Toxins from your Body!”
“Flush out Excess Pounds!”
“Break up and Remove Harmful Toxins!”

“And I trusted Oprah not to have shady doctors on, so I had a feeling this
wasn’t one of those ‘too good to be true’ products.”
“Here are some of the celebrities I found out that are using my method: Heidi Klum”
MARKETER’S POSITION
The marketer first called ERSP’s attention to the fact that several of the alleged “representative core claims” identified in the Basis of Inquiry are not made by Crush, but, instead are being disseminated by third party affiliate advertisers of whom the marketer exercise no control. Crush informed ERSP that it markets its AcaiBerry Power 500 directly only on websites that it owns, operates, and controls, as well as through banner, email and pay per click advertising that is intended to drive traffic to its website. Crush informed ERSP that it strictly controls the content of these advertisements.
Crush explained to ERSP that to drive traffic to its website, it works through an affiliate broker that, in turn, places Crush advertisements with third party “subaffiliates” who then promote the Crush advertisement for the product on websites and in email campaigns of their own design and over which they
exercise complete control (and Crush exercises none). The marketer added that it is in privity with the broker and thus can and does control the advertising for the product which the broker is authorized to place but it has no relationship contractual or otherwise – with the sub-affiliates that receive the advertising. It thus has no prior knowledge of, or power over, the content the sub affiliates create and place on their websites or the tactics they use in order to persuade consumers to click on the product banner and, in so doing, earn payment from the broker for the lead. Crush also stated that when it learns of improper conduct of the sub-affiliates, it demands that the broker halt traffic to its sites from the offending source. Crush noted that it will take whatever action it can directly against the affiliate to cut off the traffic and will consider any recourse it has in dealing with the responsible media vendor, ranging from deduction of payments for “bad traffic” to severing the relationship.
The marketer emphasized that it is not responsible for the independent third
party advertising nor for substantiating the truthfulness of it. It also added that there are no other acai berry products other than AcaiBerry Power 500 that are marketed by Crush or anyone with whom Crush is affiliated. Notwithstanding its decision to discontinue the aforementioned claims for
AcaiBerry 500, the marketer did provide ERSP with published materials
regarding antioxidant, anti-inflammatory and other health properties of acai
berry. These included recent controlled clinical studies finding a statistically
significant increase in antioxidant capacity attributable to the polyphenols found in acai berry (which the marketer maintained is higher than in most common fruits and vegetables) and increased anti-inflammatory capacity as well.
ADMINISTRATIVELY CLOSED DETERMINATION
The recent proliferation of egregious advertising claims for acai berry products has become an ongoing source of concern for ERSP, particularly (as exemplified in this matter) the practices of third party (i.e., sub affiliate) advertisers who promote acai berry products with email and banner advertising campaigns without the consent and/or knowledge of the product manufacturer. As Crush has demonstrated to ERSP, there is a body of evidence demonstrating some very real nutritional benefits in acai berries, although the extent of these benefits claimed in advertising for a number of acai berry products appears greatly exaggerated. ERSP is greatly appreciative to Crush, LLC for promptly addressing claims that have been made for which it exercises control and for its willingness to contact its online affiliate brokers when learning of inaccurate claims that are being
communicated regarding its product. Consistent with the representations made by the marketer during this inquiry, ERSP has independently confirmed that the claims at issue pertaining to AcaiBerry Power 500 for which Crush exercises direct editorial control have been discontinued and are no longer being disseminated.
Section 2.2 C (c)(ii)(d) of the ERSP Policy and Procedures provides that if …
during the course of an advertising review proceeding, ERSP determines that the advertising claims that are the subject of the inquiry have been permanently withdrawn from use … and ERSP receives the marketer’s assurance, in writing, that it has no present intention of using the claim(s) at issue in any future electronic national direct response advertising, [ERSP] shall administratively close the case file.” Pursuant to the marketer’s representation that it has voluntarily withdrawn the claims at issue in the direct response advertising and has no current intentions of disseminating the same claims again, ERSP concluded that it was appropriate and the best use of the program resources to administratively close the matter pursuant to the aforementioned section of the ERSP Policy and Procedures.

Better Business Bureau is warning consumers to be wary of online ads relying on celebrity endorsements to sell acai-berry related weight loss products. BBB has received thousands of complaints from consumers nationwide who thought they were signing up for a free-trial offer of acai berry weight loss products that were supposedly endorsed by Oprah_Rachel_Ray and other celebrities; in the end, the free trial cost them, month after month.
The acai berry has been featured on national TV shows and praised by doctors and celebrities for its high level of antioxidants. Marketing claims about the acai include that it fights cancer and aging and promotes dietary health and weight loss – and these claims are working, with sales of acai products approaching $15 million last year, up from $500,000 per year in previous years. Producers of acai berry supplements, juices and tea have been very successful peddling their goods in ads on the Internet and on social networking Web sites such as Facebook. In November alone, more than 1.5 million people searched for the term on Google. Online ads and Web sites often include a photo of a celebrity and claim that she endorses the acai as a weight loss miracle.
“BBB can’t speak to the restorative or weight loss properties of acai-based products, but we are taking companies to task for their misleading sales and marketing practices,” said Steve Cox, BBB spokesperson. “Many businesses across the country are using the same selling model for their acai products: they lure customers in with celebrity endorsements and free trial offers, and then lock them in by making it extremely difficult to cancel the automatic delivery of more acai products every month.”
Following are two companies that exemplify dozens of other businesses operating nationwide that sell acai-related items with a similar sales model:
FX Supplements
BBB serving Fort Worth recently received a large volume of complaints against FX Supplements.com, a Web site selling products such as Acai Berry Maxx and Maxx Slim Hoodia. The company offers a risk-free trial of their products for the cost of shipping and handling. However, if consumers do not cancel within the trial period they are sent additional bottles every month and are billed $85.90. Complaints show that the trial period fluctuates between 10 and 14 days from when the consumer requested the free trial—not from when they received the product.
Complainants stated they had difficulty canceling their subscription; some made numerous calls to the phone number listed, found the number out of service, continually busy or were sent to voicemail. Complainants also had a difficult time canceling their subscription via the e-mail provided. In some cases the e-mail address did not work or the complainant continued to be billed even after multiple e-mails. Several customers reported that they were forced to close down bank accounts and cancel credit cards to stop recurring charges.
Central Coast Nutraceuticals In the last 12 months, the BBB serving Central, Northern and Western Arizona has received more than 1,400 complaints for a company called Central Coast Nutraceuticals which operates several Web sites selling acai, hoodia and male enhancement products. The company uses Oprah_endorsements of the acai berry in ads touting its weight-loss benefits and offers a free trial of acai-related products including supplements and tea. Due to the company’s negative option, if, after the free-trial, the consumer no longer wishes to receive a monthly supply they must cancel their subscription or they will be billed $40 monthly.
The complaints against the company all tell a similar tale of how difficult it was to contact the company and cancel the subscription — including enduring 75 minutes on hold. Additionally, consumers complain of unauthorized charges on their credit card or bank accounts for products they did not order. Central Cost Nutraceuticals has earned an F grade from BBB for a large volume of unanswered and unresolved complaints.
“These companies are simply abusing general acai berry endorsements from well-known, trusted celebrities by using it as a tacit endorsement of their company and products specifically,” added Cox. “Consumers trust_Oprah_and unfortunately, if they are tricked into believing that she is putting her stamp of approval on a product then they are definitely more likely to purchase it.”
Before purchasing acai products, BBB recommends checking out the seller first. BBB maintains a free online database with more than four million reports on businesses.
